1. Acceptance of Terms

By using this website or booking a session with Esther Bramlett / Safire Studio (“we,” “us,” or “our”), you agree to these Terms of Service. If you do not agree, please do not use this site or book a session.

2. Description of Services

We offer massage therapy, hands-on bodywork, movement assessment, and movement coaching services, delivered in person and, for movement coaching and consultations, virtually. Services and pricing are described on this website and are subject to change at any time.

3. Not Medical Advice & Assumption of Risk

The content on this website, including blog or journal posts, videos, and any general guidance, is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified physician or other health provider with questions about a medical condition.

Massage therapy and movement coaching involve physical touch, movement, and stretching, and carry some inherent risk of soreness, discomfort, or (rarely) injury. By booking a session, you acknowledge this risk and confirm that you are voluntarily participating. If you have a medical condition, injury, or are pregnant, please disclose this before your session so your practitioner can adapt accordingly.

4. Booking, Cancellation & Payment

• Appointments are booked through our online scheduling system. A first-time consultation is required before ongoing sessions can be booked.

• Cancellations or reschedules made less than 24 hours before your appointment will be charged a cancellation fee.

• All gift cards and service packages expire within one year of purchase.

• All sales are final. We do not offer exchanges or refunds on sessions, packages, or gift cards.

• A 3.5% fee is added to all credit card transactions.

• We reserve the right to refuse or discontinue service to any client for reasons including, but not limited to, inappropriate conduct, safety concerns, or a determination that our services are not appropriate for the client’s needs.

5. Client Health Disclosures

You agree to provide accurate and complete information about your health history, current conditions, injuries, medications, and any relevant medical advice you’ve received, to the best of your knowledge, before each session. Withholding relevant health information may affect the safety or suitability of the session.

6. Intellectual Property

All content on this site — including text, photographs, video, performance footage, and design — is the property of Esther Bramlett / Safire Studio or its licensors, unless otherwise noted, and may not be copied, reproduced, or used without prior written permission.

7. User Conduct

When using this website or interacting with us, you agree not to:

• Use the site for any unlawful purpose;

• Attempt to gain unauthorized access to any part of the site or our systems;

• Post or transmit harmful code, or interfere with the site’s normal operation;

• Misrepresent your identity or health information when booking a session.

8. Third-Party Links & Services

This site uses or links to third-party services, including Acuity Scheduling for booking, a third-party payment processor, and embedded content from platforms such as YouTube, Instagram, and Substack. We are not responsible for the content, policies, or practices of these third parties. Your use of those services is subject to their own terms.

9. Limitation of Liability

To the fullest extent permitted by law, Esther Bramlett / Safire Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or our services, including but not limited to any injury, loss, or damage resulting from a session, except where caused by our gross negligence or willful misconduct.

10. Indemnification

You agree to indemnify and hold harmless Esther Bramlett / Safire Studio from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your breach of these Terms, your misuse of our services, or information you provide that is inaccurate or incomplete.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms or our services will be resolved in the appropriate courts located in Hays County, Texas.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “last updated” date. Continued use of this site or our services after changes are posted constitutes acceptance of the revised Terms.
